These Terms and Conditions (“Terms”) govern access to and use of the Patriot Pay website, platform, and related services (collectively, the “Service”). By accessing or using Patriot Pay, you agree to be bound by these Terms.
1. Overview of the Service
Patriot Pay is a software platform licensed to healthcare providers that enables medical practices to communicate directly with their own patients regarding billing statements, account notifications, and payment-related information.
Patriot Pay does not act as a billing service, collection agency, or third-party communicator. All communications sent using the platform are initiated by, sent on behalf of, and under the authority of the healthcare practice.
2. Messaging Communications (SMS & MMS)
2.1 Purpose of Messaging
Messaging through Patriot Pay is strictly limited to:
- Billing statements and balance notifications
- Payment reminders and confirmations
- Account-related notices
- Support responses initiated by the patient
Messaging is not used for:
- Marketing or promotional campaigns
- Lead generation
- Sale of goods or services
- Debt collection on behalf of third parties
2.2 Patient Consent (Opt-In)
Patients receive messages only if:
- They have provided a mobile phone number to the healthcare practice, and
- They have consented to receive electronic communications related to their account or care
Consent may be obtained through:
- Patient intake forms
- Patient financial responsibility agreements
- Electronic patient portals
- In-office or online acknowledgment of billing communications
Message content is consistent with the scope of consent provided.
2.3 Opt-Out & Help Instructions
All messages sent via Patriot Pay include clear opt-out language.
Patients may opt out at any time by replying:
- STOP – to opt out of all future messages
- HELP – to receive support or contact information
Upon opt-out, messaging will cease except where required for legal or transactional purposes.
2.4 Message Frequency
Message frequency varies based on patient account activity and practice workflows but is not excessive and is limited to what is reasonably necessary to communicate billing-related information.
3. Compliance with Carrier & Messaging Policies
Patriot Pay is designed to comply with:
- 10DLC (10-Digit Long Code) requirements
- Short Code messaging standards
- Mobile carrier policies (including AT&T, Verizon, and T-Mobile)
- CTIA Messaging Principles and Best Practices
Patriot Pay prohibits the use of the platform for:
- Spam or deceptive messaging
- Unauthorized or misleading communications
- High-risk financial solicitation
- Harassment or abuse
Healthcare practices are responsible for ensuring their patient communications align with applicable laws, including HIPAA, TCPA, and state regulations.
4. First-Party Relationship
All messages sent through Patriot Pay reflect a direct, first-party relationship between the healthcare practice and its patient.
Patriot Pay:
- Does not purchase, sell, or share patient contact data
- Does not communicate with patients independently
- Does not represent itself as a creditor or collector
5. Data Privacy & Security
Patriot Pay maintains administrative, technical, and physical safeguards designed to protect patient data in accordance with industry standards.
Use of the platform is subject to Patriot Pay’s Privacy Policy, which outlines how information is collected, used, and protected.
6. Acceptable Use
Users may not:
- Use Patriot Pay for non-authorized messaging purposes
- Send messages outside the scope of patient billing communications
- Attempt to bypass carrier safeguards or opt-out mechanisms
- Misrepresent message origin or intent
Violation of acceptable use policies may result in suspension or termination of access.
7. Disclaimer of Guarantees
Patriot Pay does not guarantee:
- Message delivery rates
- Carrier acceptance
- Patient response or payment outcomes
Delivery may be impacted by carrier filtering, device settings, or patient opt-out status.
8. Limitation of Liability
To the maximum extent permitted by law, Patriot Pay shall not be liable for indirect, incidental, or consequential damages arising from the use of the Service, including messaging delays or failures outside its control.
9. Modifications to Terms
Patriot Pay reserves the right to update these Terms at any time. Continued use of the Service constitutes acceptance of any revised Terms.
